NOTE: During our March 25 webinar it was said that the effective date of the Families First Coronavirus Response Act was April 2, 2020. The U.S. Department of Labor has since announced this will go into effect as of April 1, 2020 for both the “Sick Leave” and FMLA expansion. At the time of our recording all our research had indicated it would be April 2.

Point of Clarification: During our March 25 webinar there was a question regarding the 50 employee exemption in FMLA. To be clear, the expansion of FMLA eliminated the automatic 50 employee or less exemption for small businesses, but only as it relates to childcare issues in conjunction with the Coronavirus epidemic. What they did add back in was a potential exemption, for 50 or less employees, if providing FMLA leave for these individuals would jeopardize the ability of the business to continue. We apologize for any confusion this may have caused.
